What have I done? ( huge ebay mistake )

Sold 2 identical items last week for £600 each, one buyer paid up and I posted the item, he left feedback after receiving it and that's that. But the other buyer did not pay and a case then opened for payment, he seemed nice and promised he will pay but needed an extra couple of days ( had great feedback too ) and was really apologetic, so I turned off the 'unpaid item assistant' to give him a little more time. So today comes which was the time limit I gave him to pay by, messages me and apologises to say he can't get the money, now here's where it gets ****ed up.

Because I turned off the unpaid item assistant the ebay system decided to get all glitchy and would not let me cancel the transaction, so I got onto live chat to ask ebay to cancel it for me, gave them the item number and they said they're happy to tell me they've cancelled it and refunded the payment back..... i'm thinking what payment?? ( they hadn't paid ), then it dawned on me when I checked the item number I gave them, it was for the transaction for the guy who paid, so now he has my £600 item AND his full money back and my paypal account is wiped to zero. :shock: :shock:

I was 100% ****ing positive I copied & pasted the correct item number from my sales history to give to ebay on live chat, so when looking into it I quickly found out what's happened, you know when you click onto a new page and it takes several seconds to fully load?, when you start scrolling down as soon as you're on the page and you get that page judder which makes it shift back up a little bit once fully loaded?. That's what's bloody happened, I went to my ebay page and immediately scrolled down to the sold item and when I was just about to drag over the item number to copy it, the page shifted upwards and basically replaced the unpaid item I was looking at with the paid one directly underneath it, into the exact same spot on the screen, and because both images and titles were exactly the same I didn't notice it happen. I don't know if this makes me feel like less of a **** because technically I didn't make the mistake, or if it makes me angry that that happened. :lol:

Iv'e fired away a message an hour ago to the buyer who's been accidentally refunded explaining what's happened, and kindly instructing them to send the money back to my paypal account, so I just need to hope now that this buyer is honest and pays it back. Iv'e just been reading a few posts online of sellers who have made the same mistake all of who have said the buyer is ignoring them, and tons of replies from people on the forums saying they can say goodbye to their money.

Does anyone know where I stand legally with this if I get no response??, I did read one post from someone saying it's actually illegal for them to keep the money even if it's sent to them by mistake, such as when a bank accidentally puts money into your account, or when a workplace pays you too much and you legally have to pay it all back. Is this also true in my situation here?

I will probably give the buyer 1 week to respond and then proceed with a letter in the post to him instructing to pay the money back within 30 days before taking court action, and then small claims court if still no response. Hopefully it doesn't come to any of this and the buyer is honest.

I feel for you on that. That's one massive headache. If he doesn't respond try calling eBay back or even PayPal. They might be able to resend it without having to go through him. Hope you get it sorted.

Thanks mate, unfortunately refunds can't be reversed, once a transaction is cancelled and refunded there's no system in place to get it back, nor can ebay or paypal have any control over forcing buyers to send money back, so the only one way is for the buyer themselves to send the money.

I'm still slightly annoyed at how the ebay support rep just went ahead and refunded that amount of money on the transaction, right after I explained to them that the buyer had not paid for it and that a non-payment case was open on it, before they refunded it for me you'd have thought they would have noticed on their end that the order was paid for and dispatched etc, and double checked with me that I gave them the correct item number. But, at the end of the day it is my fault for giving them the wrong number, I may just have to take it as a very expensive mistake.

It's just a waiting game now to see if the buyer responds. :|
 
What a nightmare and easily done, you would hope the buyer has some self respect and gives you the money back promptly. I know I would, don't worry if not you have his address. :lol: I would fire a letter out to him within a couple of days if you don't get a response with 48 hours, saying you will take him to a small claims court.
 
Very sorry to read this has happened. Surely though if you explained the situation to eBay, they should be able to do something? Yes you made a mistake, but by the sounds of things, at the very least, eBay could have been a lot more thorough in their actions too.

If it makes you feel any better, there are a few of us honest people left in the world, so let's hope the recipient of the refund sends it back to you without any hassle.

Thanks guys, it's a bit of a nightmare, but onward & upwards I suppose, there really is nothing ebay or paypal can do, the rep said the only thing they can do is message the buyer on my behalf, and when the rep showed me the message for me to approve before he sent it the damn thing didn't even make any sense, it was like reading a paragraph a Chinese person wrote who wasn't good with grammar. :lol: So I said to leave it and i'll message him myself.

Still no response yet, but it's only been half a day and not everyone spends every day on ebay, so fingers crossed, i'll def update on here if/when anything happens.
 
Yeah the buyer may not even no he's been refunded yet. He's got to give the money back.

Good news!, he's replied back and agreed to give me the money back. :)

I was beginning to think he was ignoring me, ( maybe he originally was but changed his mind, who knows ) but he responded and said he was busy which is why he's responded late. He originally replied and said he didn't have the money, but as soon as I showed him screenshots of the refund he said he checked his account again and found it...

Very lucky with that, it's a mistake i'll literally never make again, he could have been one of the many dishonest ones who tried to keep it.
